By signing this Agreement, Owner agrees to the following terms when listing crash pads ("Rental Equipment") on CrashPal’s platform.

1. Owner Responsibilities

1.1. Owner is responsible for ensuring the Rental Equipment is in safe, usable condition before each rental.
1.2. Owner agrees to accurately describe the condition, size, and features of the crash pad in their listing.
1.3. Owner must inspect the pad before and after each rental and report any issues to CrashPal within 48 hours of return.
1.4. Owner must clean the crash pad before renting it out and may charge a reasonable cleaning fee if returned excessively dirty.

2. Liability & Risk Acknowledgment

2.1. Owner understands that climbing is an inherently risky activity and that CrashPal is not responsible for injuries, accidents, or damages related to the use of the Rental Equipment.
2.2. Owner agrees that CrashPal is not liable for any claims, damages, losses, or injuries related to their listed crash pads.
2.3. Owner releases CrashPal from any liability arising from the Borrower's use of the Rental Equipment.

3. Damage, Theft & Payment Terms

3.1. Borrower Liability: If a Borrower damages the Crash Pad during the Rental, CrashPal will do its best to cover the cost of damage and replacement, but it's not guaranteed. (Valid documentation will help your case a ton)

3.2. Borrower Theft: If a Borrower steals or fails to return the Rental Equipment, CrashPal will do its best to cover the cost of damage and replacement, but it's not guaranteed. (Valid documentation will help your case a ton)

3.3. Owner’s Damage Claim Process:

• Owners must report damage or theft to CrashPal within 48 hours of the rental’s return date.
• If the Borrower has Damage Protection, CrashPal will facilitate reimbursement.
• If the Borrower does not have insurance, the CrashPal may pursue direct reimbursement from the Borrower.

4. Cancellations & Refunds

4.1. If an Owner cancels a confirmed booking, CrashPal may refund the Borrower in full and assist in securing a replacement rental.
4.2. Frequent cancellations by the Owner may result in temporary suspension or removal from the platform.

5. Indemnification

5.1. Owner agrees to defend, indemnify, and hold harmless CrashPal from any claims, disputes, damages, or liabilities related to their Rental Equipment.

6. Agreement & Termination

6.1. This Agreement remains in effect as long as the Owner has an active listing on CrashPal.
6.2. CrashPal reserves the right to modify these terms or remove an Owner from the platform for violations of this Agreement.
